Several years ago, Chinese embassies and consulates in foreign countries issued notices on their official websites and wechat accounts to adjust their visa policies for foreigners. At the same time, foreigners are asked how to apply for a domestic work visa if they find a suitable job after entering the country.



Basic conditions of the employer

1. Established according to law, no record of serious illegal and dishonest;

2. The positions employed by foreigners should be those with special needs, which are temporarily short of suitable candidates in China and do not violate relevant regulations of the State;

3. If laws and regulations require prior approval by the competent industry authorities, approval shall be required.


Applicant basic conditions 

1. The applicant shall be at least 18 years old, in good health, without criminal record, have confirmed employers in China, and have the necessary professional skills or appropriate knowledge level for his/her job.

2. The work is in line with the needs of economic and social development, and is a professional in urgent need of domestic shortage.

3. If laws and regulations provide otherwise for foreigners to work in China, such provisions shall prevail.


Standard picture for Foreigner Work Permit

Foreign high-end Talents (Category A) Foreign high-level talents, such as scientists, leading scientific and technological talents, international entrepreneurs, specialized and special talents, which are urgently needed by China's economic and social development, and meet one of the following conditions and the key list of foreign talents introduced by the state, shall be classified as category A, and "green channel" and "accepting and accepting" services shall be implemented. (1) Those selected for the domestic talent introduction program

(2) Conforming to internationally recognized standards for recognition of professional achievements

(3) Foreign talents who meet the requirements of market-oriented encouraged positions

(4) Innovative and entrepreneurial talents

Foreign Professionals (Category B)

(1) Foreign professionals with bachelor's degree or above and more than 2 years of relevant work experience. In accordance with one of the following provisions:

1. Managers or professional and technical personnel engaged in scientific research, teaching and management in the special fields of education, scientific research, journalism, publishing, culture, art, public health, sports and so on.

2. For the personnel executing the agreements between Chinese and foreign governments, agreements between international organizations, and Sino-foreign trade and engineering contracts, the age requirements for the personnel dispatched by internationally renowned academic institutions and scientific and educational international organizations shall be relaxed accordingly in accordance with the provisions of the inter-governmental exchange and cooperation agreement.

3. Personnel employed by representative offices of international organizations in China and representatives of foreign expert organizations in China.

4. Middle-level or above employees dispatched by multinational companies, chief representatives and representatives of resident representative offices of foreign enterprises in China.

5. Foreign managers or professional and technical personnel employed by various enterprises, public institutions and social organizations.

(2) Holders of international general vocational skills qualification certificates or skilled personnel in urgent need.

(3) personnel teaching foreign languages.

(4) Foreign talents whose average wage income is not less than 4 times of the average social income of the previous year in the local area.

(5) Specialized personnel who meet the requirements of relevant departments of the State and personnel who carry out projects.

(6) Professionals with points of 60 or more.


Other Foreign personnel (Category C) Other foreign personnel who meet the needs of the domestic labor market and meet the requirements of national policies are identified as Category C, which mainly includes:

(1) foreign personnel who conform to the current regulations on the administration of foreigners working in China;

(2) Foreign personnel engaged in temporary or short-term work (not exceeding 90 days);

(3) Persons under the administration of the quota system, including foreign youth who come to China for internship in accordance with inter-governmental agreements, foreign students who meet the prescribed conditions, foreign graduates of overseas universities, foreigners working in special fields such as deep-sea fishing, etc.

Points for attention in bidding

1) Foreigners have no bad record in their home country and cannot violate Chinese laws and regulations after entering China

2) Foreigners who change their names shall apply for a certificate of name change and be certified by the Chinese Embassy

3) If the university degree does not reflect the bachelor's degree, the certificate equivalent to the Chinese bachelor's degree shall be issued in the local education bureau

4) For foreigners with multi-country passports, their entry visa status and work visa status must be consistent

5) Foreign Chinese who have acquired foreign nationality shall submit Chinese household registration cancellation certificates

6) Companies that employ foreigners must operate legally and have a real office address

7) True employment of foreigners (with employment contract)

8) Foreigners are not allowed to work in other companies after obtaining work permits and work visas.
