No criminal record notarization is often used for immigration, study abroad, family visits, or job applications at home and abroad. So if foreigners who live or have lived in China need to apply for proof of no criminal record and notarization, how should they deal with it?

The following is to share with you the materials and procedures required for foreigners living or ever living in China to apply for notarization without criminal record. Those who need to apply for notarization can collect them.

How do foreigners apply for notarization of no criminal record?

List of materials required:

1.Foreigners present their full passports and old passports that reflect their time of residence in China.

2.Photo of applicant: The required number of notarial certificate +1 is provided, which is a two-inch bareheaded photo with the same background.

3.Certificate of no criminal record issued by exit-entry administration departments of local public security bureaus.

4.Sample of proof of non-criminal record of aliens

If not in person, should also provide the power of attorney and the identity of the agent.

5.Other materials deemed necessary by the notary public.

Handling process

The applicant should bring the original passport to the notary office with foreign-related qualifications to apply for the application. The applicant should provide the specific period during which he/she needs to apply for the notarization of no criminal record.

If the applicant has left the country, he/she must entrust an agent to carry the agent's ID card to the foreign notary office for application.

A power of attorney should be provided, which specifies that the trustee is entrusted to notarize no criminal record. A photograph of the applicant holding the power of attorney and his/her passport should also be provided.

Criminal record query method

According to the Ministry of Public Security issued the Regulations on the Handling of Criminal Record Inquiry by Public Security Organs (Gongtong Zi (2021) 19), starting from December 31, 2021, foreigners in Han can apply for criminal record inquiry directly at the Exit and Entry Administration department of public security organs!

Application requirements: a person who has held a residence permit and resided in China for at least 180 days after his/her first entry.

Place of application: residence permit, permanent residence permit and actual residence for more than 180 days (including) can be applied for either.

Materials to submit: valid identification and inquiry form.

In case of entrusting others to inquire, the power of attorney and the valid identity certificate of the agent shall also be submitted.
